Terms of Service

1. Acceptance of Terms

By accessing or using CreatorWow ("Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Platform. These terms apply to all users, including creators, brands, and visitors.

2. Platform Description

CreatorWow is a performance-based creator marketplace that connects brands with TikTok content creators. Brands post campaigns with defined budgets and requirements; verified creators submit original TikTok content for consideration. Payouts are performance-based and subject to campaign terms.

3. Creator Accounts

To submit content to campaigns, you must create a creator account and connect a verified TikTok account. You represent that all content you submit is original, does not infringe any third-party rights, and complies with TikTok's Community Guidelines and applicable advertising standards (including FTC disclosure requirements).

By submitting content, you grant CreatorWow and the relevant brand a non-exclusive, royalty-free license to track, display, and reference your submitted content for campaign reporting and platform marketing purposes.

4. Brand Accounts & Payments

Brands must pay the full campaign budget upfront via Stripe before a campaign goes live. Funds are held in escrow and released to creators upon admin approval of qualifying submissions. CreatorWow charges a platform fee of 15% on all brand budgets, deducted at the time of checkout.

Refunds for unused campaign budget (spots not filled by the deadline) will be processed within 10 business days of campaign closure, minus any applicable fees.

5. Payouts to Creators

Creator payouts are processed within 14 business days of submission approval. Payouts require a valid payment method on file. CreatorWow reserves the right to withhold payment for submissions that violate campaign requirements, these Terms, or applicable law.

Creators are responsible for reporting all income received through the Platform to the appropriate tax authorities. CreatorWow may issue tax forms (e.g., 1099) as required by law.

6. Prohibited Conduct

You agree not to:

• Submit fake, purchased, or artificially inflated view counts
• Create multiple accounts to circumvent campaign limits
• Submit content that is misleading, defamatory, or violates any third-party rights
• Attempt to reverse-engineer or scrape the Platform
• Use the Platform to distribute spam or unsolicited communications
• Impersonate any person or entity

7. Intellectual Property

The CreatorWow name, logo, and all Platform content are the property of CreatorWow Inc. and are protected by applicable intellectual property laws. You may not use our trademarks without prior written consent.

8. Disclaimers & Limitation of Liability

The Platform is provided "as is" without warranties of any kind. CreatorWow does not guarantee campaign results, specific view counts, or creator earnings. To the maximum extent permitted by law, CreatorWow's liability is limited to the amount paid by you to us in the 12 months preceding the claim.

9. Termination

CreatorWow reserves the right to suspend or terminate any account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Platform ceases immediately.

10. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes constitutes your acceptance of the revised Terms. We will notify registered users of material changes via email.
